1 Acceptance of Terms

By accessing or using our website (Roofing Servicesroofing.com), submitting a form, requesting an estimate, scheduling a service, or entering into a service agreement with Roofing Services ("Roofing Services," "Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions, along with our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms, you must immediately cease use of our website and not request or engage any services from Roofing Services

These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Roofing Services, a Texas corporation with its principal place of business at 1234 Roofing Services Blvd, Suite 500, Austin, TX 78701.

2 Description of Services

Roofing Services provides the following residential and commercial roofing services across the United States:

• Roof installation, replacement, and repair for residential and commercial properties
• Storm, hail, and wind damage assessment and restoration
• Insurance claim consultation, documentation, and negotiation assistance
• Roof inspections, maintenance programs, and preventive services
• Solar roofing installation and integration
• Gutter installation, repair, and replacement
• Ventilation, skylight, and chimney flashing services

The specific scope of services for your project will be defined in the individual service contract executed between you and Roofing Services. These Terms apply to all services unless expressly modified in a signed service agreement.

3 Estimates & Pricing

• All estimates provided by Roofing Services are free of charge and are valid for a period of 30 days from the date of issuance unless otherwise stated in writing.
• Estimates are based on visible conditions at the time of inspection. If hidden damage is discovered during the course of work (e.g., rotting deck, structural issues, insufficient ventilation), additional costs may be required. We will notify you and obtain your approval before proceeding with any additional work.
• Prices are subject to change based on material cost fluctuations, code changes, or modifications to the scope of work requested by the customer.
• Estimates do not constitute an offer or contract. A binding agreement is formed only upon execution of a signed service contract by both parties.

4 Contract Formation

A binding service contract is formed when: (a) you sign a written proposal or service agreement provided by Roofing Services, or (b) you provide verbal or electronic acceptance of a proposal followed by Roofing Services's commencement of work or ordering of materials on your behalf. The signed contract will specify the scope of work, materials, timeline, pricing, payment terms, and any project-specific conditions.

For projects exceeding $500, a written contract signed by an authorized representative of Roofing Services and the Customer is required. Verbal agreements for projects over $500 are not enforceable under these Terms.

5 Payment Terms

• Deposit: A deposit of up to 33% of the total contract price may be required at the time of contract signing to secure materials and schedule the project.
• Progress Payments: For projects exceeding $10,000, progress payments may be required at specified milestones (e.g., material delivery, completion of tear-off, completion of installation).
• Final Payment: The remaining balance is due upon substantial completion of the project. Final payment must be made within 10 business days of completion notification.
• Accepted Methods: Check, ACH/bank transfer, credit card (Visa, Mastercard, Discover, AmEx), and financing through approved lending partners.
• Late Payments: Past-due balances will incur a late fee of 1.5% per month (18% per annum) on the outstanding balance. We reserve the right to suspend work on any project with an overdue payment.

6 Warranty

Roofing Services provides the following warranty coverage:

Warranty Exclusions: Damage from foot traffic, satellite dishes, antennas, improper ventilation, ice dams (unless ice & water shield was specified), failure of underlying structure, pest damage, chemical exposure, or modifications by other contractors. Warranty is transferable to subsequent property owners upon written notification to Roofing Services.

7 Insurance Claims Assistance

• Roofing Services provides insurance claim assistance as a courtesy service. We are not a public adjuster and do not act as your legal representative in insurance matters.
• Any estimate or documentation provided to your insurance company represents Roofing Services's professional opinion and is not a guarantee of claim approval or payment amount.
• The final determination of coverage and claim amount rests solely with your insurance company. You are responsible for any costs not covered by your insurance policy.
• If your insurance claim is denied or underpaid, you retain the right to pursue additional appraisal or legal remedies independently. Roofing Services is not liable for the outcome of any insurance claim.

8 Property Access & Site Conditions

• You grant Roofing Services and its subcontractors access to your property during agreed-upon working hours for the duration of the project.
• You are responsible for removing personal items, vehicles, and fragile decorations from areas around the work zone prior to the start of work.
• Roofing Services will take reasonable precautions to protect your property but is not liable for damage to items left in the work zone, pre-existing conditions, or landscaping that may be affected by normal roofing operations (e.g., debris on grass, minor plant damage near the structure).
• You must inform Roofing Services of any known hazardous conditions on the property (asbestos, lead paint, underground utilities, etc.) prior to the start of work.

9 Cancellation Policy

To initiate a cancellation, send written notice to billing@Roofing Servicesroofing.com or via certified mail to our business address. Cancellation is effective upon our receipt of your written notice.

10 Limitation of Liability

• Roofing Services's total liability for any claim arising from or related to our services shall not exceed the total amount actually paid by you to Roofing Services for the specific project giving rise to the claim.
• Roofing Services is not liable for delays caused by weather conditions, material shortages, labor disputes, government actions, utility company delays, or other circumstances beyond our reasonable control.
• Roofing Services is not responsible for damage to interior contents caused by leaks that occur after the customer has been notified of needed repairs and declined to proceed.
• Some states do not allow the exclusion or limitation of certain damages. If applicable law does not allow these limitations, the above limitations may not apply to you.

11 Indemnification

You agree to indemnify, defend, and hold harmless Roofing Services, its officers, directors, employees, agents, subcontractors, and affiliates from and against any and all claims, demands, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your breach of these Terms
• Your negligence or willful misconduct related to the project
• Failure to disclose known hazardous conditions on your property
• Unauthorized modifications to completed work
• Any misrepresentation you make regarding your property or insurance coverage

12 Dispute Resolution

12.1 Informal Resolution

Before initiating any formal proceedings, you agree to first attempt to resolve any dispute with Roofing Services by contacting our customer service department at Call Now or support@Roofing Servicesroofing.com. We will attempt to resolve the dispute within 30 days of receiving your complaint.

12.2 Binding Arbitration

If the dispute cannot be resolved informally, you and Roofing Services agree to resolve the dispute through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in the county where the project is located, unless otherwise agreed.

12.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Roofing Services.

12.4 Jury Trial Waiver

To the extent permitted by applicable law, you and Roofing Services hereby waive any right to a trial by jury in any litigation arising from or related to these Terms or our services.

13 Intellectual Property

All content on the Roofing Services website, including but not limited to text, graphics, logos, images, photographs, videos, icons, audio clips, software, and the overall design and layout of the website, is the property of Roofing Services or its content suppliers and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any materials from our website without our prior written consent, except as follows:

• Your computer may temporarily store copies of materials in RAM incidental to your accessing and viewing those materials
• You may store files that are automatically cached by your web browser for display enhancement purposes
• You may print or download one copy of a reasonable number of pages for personal, non-commercial use

"Roofing Services," "Roofing Services," the Roofing Services logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Roofing Services You may not use these marks without our prior written permission.

14 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

For any matter not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Travis County, Texas, and waive any objection to venue in those courts.

15 Changes to These Terms

Roofing Services reserves the right to modify or replace these Terms at any time at our sole discretion. When we make changes, we will:

• Update the "Last Updated" date at the top of this page
• Post a notice on our website for material changes
• For existing service contracts, material changes will not apply retroactively without your written consent

Your continued use of the website after changes are posted constitutes acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
